No. The FTC requires a federal judge to provide an injunction to prevent two companies from merging.

After the merger completes this is literally useless. Im guessing what the FTC would try to do is to make a sham ruling thats not enforceable but they will cite in the future to get even more idealistic.

Which is wild because with the split in the house and senate thats very unlikely. Its not unlikely though that the very conaervative supreme court could useone of their current cases and this mass overreach to strip the FTC of powers.

Just a small question, as I don’t really know how things work at the FTC. If they decide to not let the deal pass during their administrative ruling, can they undo the deal just like that, or would they need a federal judge for that ?

Translation: Screw filler.

No. In short the administrative process is just them blowing stuff just to get a recommendation on whether to pursue a federal case or not. They do not have any legal power to breakup a company

They would need to sue in federal court based on their ruling.

If they follow this all the way through it is likely that the ALJ would advise ruling in favor of Microsoft and then the FTC would vote on whether to affirm that suggestion or to sue in federal court. Currently, the FTC is made up of 3 Dems and 2 Reps so if it goes along party lines then it would go to suing in court. Courts would likely affirm the decision by the 9th circuit.

This is beyond funny as the merger will have been completed by any sort of decision so from my understanding the FTC would need a judge to unwind it.

The problem for them is that they would have to show actual harm I believe, which is going to be impossible. Plus, the one potential avenue they could have gone down is cloud and that has been neutered completely by the CMA.

I don’t like that the government is wasting my hard earn tax dollars to keep pursuing something that has already failed. What’s their end goal here, keep throwing sh*t at the wall till it sticks? Gain sympathy from both political parties(doubt the GOP would even giver her the time of the day, same with moderate dems), or her ego is just hurt. She needs to focus on battles she can fight that truly matter, like the Amazon case, which will take a lot of resources instead of wasting it with this.
